1. APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS

1.1

These general terms and conditions, which are published online by the seller at www.geneziswear.com, determine all offers, orders, agreements and other legal relations between the buyer and the seller regarding the use of the website. Including the purchase of a product on or through the website.

2. PROCESSING OF PERSONAL DATA

In the course of its business activities and the offering and provision of products and services, Genezis will need to process personal data. “Personal data” is any information that can be used directly or indirectly to identify a natural person. You provide most of your personal data directly to Genezis. In some cases, your personal data is collected automatically by Genezis or obtained from a third party source.

Below we will explain, by categories, as shown in paragraph 1, which personal data is processed by Genezis, for what purpose and on what legal basis. You may fall into more than one category, for example if you are a Genezis customer and also participate in a Genezis promotional activity.

2.1You are a Genezis customer

Genezis processes personal data of its customers to enable the sale of products for which Genezis needs to conclude an agreement with you, process the payment and ship the product to you. In addition, Genezis needs to process the data to ensure security, prevent fraud and register payments.

In this context, Genezis processes the following personal data:

* Customer information, including name, address (for invoice/cash receipt and for delivery), e-mail address and telephone number;

* Order information, product type, size, payment method, delivery method and order history;

Promotional activity. Genezis may organize promotional activity in which you may participate. In order to conduct this activity, including selecting a winner and communicating the results, Genezis may require the following information:

* Customer information, including your name, address, e-mail address, age, gender, date of birth, nationality and telephone number;

* Promotional information, including the content you provide for the purpose of participating in the promotional activity;

* Technical information, including a promotional code;

The legal basis for this processing of personal data is that the processing is necessary for the performance of contractual relations with customers, for the legitimate business interests of Genezis, for the provision and improvement of their services and/or for compliance with Genezis’ legal regulatory requirements.

2.3You visit the online store

If you visit the online store, Genezis will automatically – (after obtaining your consent, where required by law) – collect information through cookies and similar technologies. This information may consist of:

3. DELIVERY METHOD AND DATES

3.1. The shipment will be made with a carrier designated by the SELLER.

3.2. After the contract is concluded, the SELLER will send the products as soon as possible, within 14 days to the address specified by the BUYER. This is provided that the SELLER has received the full value of the product, or the contract includes payment upon receipt of the product.

In the event of an order placed during a “pre-order” period, the product will be sent within the time specified in the campaign information.

3.3. The Seller will make the delivery in accordance with the agreed dates. The Buyer acknowledges that the delivery dates are based on circumstances that may be dictated by third parties responsible for the transport and provision of the shipments.

3.4.Within 14 (fourteen) days after the conclusion of the contract, in the event that delivery is delayed or that an order cannot be shipped in whole or in part, the SELLER has the right to terminate the contract, completely free of charge, and to notify the BUYER thereof.

3.5. The risk of damage to or loss of the products shall pass to the buyer from the moment the products are delivered.

4. PRICES AND PAYMENT METHOD

4.1. The prices indicated on the website are denominated in local currency or in euros, include value added tax (VAT) and do not include delivery costs. Delivery costs are added during the final steps of the order. The total purchase price payable will be indicated when the order is placed and upon confirmation of the agreement.

4.2. The Seller has the right to periodically adjust the prices indicated on the website without notice. The prices indicated at the time of placing the order are considered prices that are part of the agreement.

4.3. Payment can be made by the following methods:

*Cash on delivery – must be made within 7 days after delivery of the product to a courier's office or directly upon receipt of the goods to the address by the courier.

*Payment by bank transfer – must be made within 14 days after placing the order using the bank transfer details provided by us. If the transfer is not received (after 14 days), the order will be canceled.

*Payment by debit / credit card via V-pos

The website www.geneziswear.com accepts payments by debit and credit cards via V-pos. The types of cards accepted are debit, credit and business cards Visa and Mastercard. Card transactions are carried out using the MasterCard Identity Check and VISA Secure security programs. From a security point of view, the maximum amount for payment by debit / credit card is 1000 BGN. We do NOT store data on bank cards used for payment through the site. If it is necessary to return an amount paid by bank card, the amount is refunded to the card with which the payment was made.

4.4. The Buyer is obliged to notify the Seller of any problems or any errors in entering data during payment.

5. RIGHT OF REFUSAL AND RETURN OF GOODS

5.1. The consumer may refuse ordered and delivered products only in the following cases:

– there is a visible discrepancy between the delivered product and the order, which can be established by a simple inspection of the product

– the product has suffered damage/defect during transportation

– the price upon delivery does not correspond to the previously agreed price

5.2. Pursuant to Article 50, 55 (paragraph 1) of the ZZPPT, the buyer has the right to return the product within 14 days (2 weeks) after receipt, without specifying any reason for the return only if:

* The product has not been worn, worn or washed

* The product is not damaged and has no defects

* The product is returned in the original packaging, together with all labels, in the manner in which it was received

The return of the products in this case is at the expense of the buyer. The value of the goods is refunded by the trader via bank transfer with the buyer's bank details provided.

Our customers have the exclusive right to return/exchange goods within 30 calendar days of the date of receipt of the goods ordered by them.

To exercise your right of withdrawal, you must inform us of your decision by sending an email to returns@geneziswear.com

Out of concern for our customers and due to the nature of the goods sold, products such as socks and underwear CANNOT BE RETURNED or EXCHANGED!

5.3. The buyer has the right to replace the product(s) he/she ordered with another/other products, only if the desired replacement products are of the same or higher price than the ordered ones. In case the price of the desired replacement products is higher, the difference is added to the price of the new shipment. We only replace products that meet the following requirements:

* The product has not been worn or washed

* The product is not damaged and has no defects

* The product is returned in the original packaging, along with all labels, in the way it was received

5.4. In the case referred to in the previous section, the seller shall refund the purchase price as soon as possible (within 30 days) after Genezis has received the returned goods. If not all products that were part of the agreement are returned, the seller shall be entitled to deduct the original delivery costs from the purchase price to be refunded, as the same amounts will be due for the products that are not returned.

6. FORCE MAJEURE

6.1

The Seller is not liable for any damages resulting from a delay in delivery or non-delivery of a product caused by circumstances that prevent the Seller from fulfilling its obligations in accordance with the law, legal act or in accordance with generally accepted standards in the event of war, threat of war, civil war, riots, a day of national mourning declared by the government, strikes, transport problems, trade restrictions, problems with customs authorities, fire, flood, earthquake, bankruptcy of third parties engaged by the Seller, failure of suppliers, interruption of third party supplies, including interruption of water and electricity, as well as other serious interruptions of the Seller's commercial operations or third parties engaged in the commercial process.

6.2

If, as a result of a force majeure situation, the Seller fails to perform its obligations, it shall be entitled to partially perform or not perform the contract, without the Seller being obliged to pay the Buyer any compensation in this regard.

7. COMPLAINTS

7.1

The contact details of the Seller and the third parties engaged in handling complaints can be found by clicking on the “Contact Us” button on the Website.

7.2

The Buyer shall be obliged to inspect the Product upon delivery and to notify the Seller within a reasonable time in the event of any visible defects or other complaints regarding the performance of the Agreement. Such complaints shall be submitted in writing and shall be fully and clearly substantiated.

7.3

The Seller shall respond to all complaints it receives within 14 days of receipt. The Seller shall notify the Buyer within 14 days if it is foreseeable that the complaint will require a longer period of processing, indicating the period within which the Buyer can expect to receive a response.

7.4

The Buyer acknowledges that minor deviations and deviations that are usually considered acceptable in terms of quality, size, color, manufacturing method, etc., of the products, or deviations that cannot be avoided, do not constitute a valid reason for filing a complaint. Such complaints or complaints regarding the removal of products from the site are not justified. The Seller shall not be liable for damages that the Buyer suffers as a result of such deviations.

7.5

The Buyer shall provide full cooperation in the event that the Seller requests the return of a product. The Buyer shall immediately notify the Seller in the event that a safety-related defect is suspected that can be remedied.

8. INTELLECTUAL PROPERTY RIGHTS

8.1

Any and all trademarks, product names, logos, models and designs (hereinafter referred to as IP) that are depicted on or in connection with the Products are the property of the Seller or one or more of its subsidiaries. The Buyer acknowledges the Seller’s ownership rights in respect of the Intellectual Property Rights and shall refrain from using them in any manner.

9. RETENTION OF TITLE

9.1

The Seller shall retain title to all goods to be delivered until the following obligations to it have been fully complied with:

* The performance and obligations (including payment obligations) that the Buyer owes in respect of all goods that have been or are to be delivered under the agreement;

* Claims by the Buyer based on breach of this agreement;

10. WARRANTIES AND LIABILITY

10.1

The Seller is legally obliged to provide a product that complies with the contract with the Buyer.

10.2

The Seller is not liable for any indirect, incidental or consequential damages of any kind. In no event shall the direct damages for which the Seller is not legally liable to the Buyer exceed the purchase price. This provision is not intended to exclude the Seller's liability in the event of personal injury or death.

10.3

The Seller hereby disclaims liability in relation to its liability in relation to the Website and the use of the Website.

11. GOVERNING LAW

11.1

This agreement shall be governed by the law of the country in which you reside.

12. INVALID PROVISIONS

12.1

In the event that any provision contained in these Terms and Conditions is invalid:

* the remaining provisions contained in these Terms and Conditions shall remain in full force and effect;

* the invalid provision shall be interpreted or converted into a valid provision having the same purpose to the greatest extent possible;

13. AMENDMENT OF THE GENERAL TERMS AND CONDITIONS

The Seller has the right to amend these General Terms and Conditions from time to time. The most recent version of the General Terms and Conditions will be posted on the Website. The Buyer should always consult these General Terms and Conditions before using the Website. If the Buyer is unable to access the General Terms and Conditions via the Internet, the Seller will send the Buyer a copy of the most recent version of the General Terms and Conditions via e-mail.
